April 9 case management date for author’s appeal on book ban

PUTRAJAYA: The Court of Appeal here yesterday has fixed  April 9, for case management of the appeal by the author and publisher of the book, ‘The March to Putrajaya – Malaysia’s New Era Is At Hand’ over the home minister’s decision to ban and seize 33 copies of the book.

A three-member panel chaired by Justice Datuk Seri Mohamed Apandi Ali fixed the date after allowing Yong Thye Chong and Oriengroup Sdn Bhd’s application to postpone the hearing of  their appeal which was set for today.

The other two judges presiding on the panel were justices  Datuk Alizatul Khair Osman Khairuddin and Datuk Aziah Ali. Yong’s counsel, K Shanmuga, applied to postpone the hearing to wait for the Federal Court’s decision in two other book ban cases which were still pending  at the Federal Court, at the leave to appeal stage.

Senior Federal Counsel Noor Hisham Ismail did not object to the application.

On July 14, 2011, the Kuala Lumpur High Court dismissed the judicial review brought by Yong and Oriengroup to challenge  the decision of the minister to  ban and seize the books.

They sought to declare that the confiscation of the books on  Aug 19, 2010 was unlawful and wanted the minister to lift the ban.

Yong, 74, who writes under the name, Kim Quek, was represented by counsel Shanmuga and  Edmund Bon. — Bernama
