SANDAKAN: A local man was sentenced to 12 months’ jail by the Magistrate’s Court here yesterday after pleading guilty to molesting his 33-year-old sister-in-law.
Azmi Bin Dagung, 40, pleaded guilty before magistrate Jessica Ombou Kakayun to the charge framed under Section 354 of the Penal Code for using criminal force with intent to molest.
The offence provides for a maximum 10-year jail sentence, a fine or whipping, or one of the three upon conviction.
He was alleged to have committed the offence at a house in Sandakan town on January 3 this year around 12.30am. He was arrested on the same day around 2.30am after the complainant lodged a police report.
Based on the facts of the case, the accused was alleged to have touched the complainant’s breast while she was sleeping in the living room. The complainant woke up while the accused was in the act of touching her breast.
Investigation revealed the accused is the husband of the complainant’s adopted sister and they all live in the same house.
