Court of Appeal fines trader RM3,000

KUCHING: A man was slapped with a RM3,000 fine in default two months’ jail by the Court of Appeal here yesterday after his acquittal decision by the Sessions Court last year for selling unregistered products was set aside.

It was a unanimous decision by Judges Datuk Abdul Wahab Patail, Datuk Tengku Maimun Tuan Mat, Datuk Dr Hamid Sultan Abu Backer on the appeal by the prosecutor against respondent Mohd Rizal Rajinder Abdullah, 47.

Rizal was represented by defence counsel William Liau, while DPP Awang Armadajaya Awang Mahmud appeared as the appellant.

The respondent was found guilty of selling eight unregistered products at a stall set up at D’Rizma Trading at Limbang Plaza basement during a raid conducted by the Health Ministry officers at about 12pm on May 24 last year.

On July 25, he was convicted by a Limbang Sessions Court after pleading guilty to the charge and was fined RM30,000 in default 14 months in jail.

Not satisfied with the decision, Rizal appealed against his conviction and was freed from the offence by the High Court.

The prosecutor subsequently appealed against the decision made by the High Court.
