No semen found on girl’s perineum swab, court told

KOTA KINABALU: A chemist told the Sessions Court here yesterday that she did not find any presence of semen or blood on a Kota Marudu girl’s perineum swab in relation to a Pakistani trader who was tried for allegedly causing the death of the girl.

The prosecution’s witness two, Rita Tie Ung Ha, 32, was testifying before judge Duncan Sikodol during cross-examination-in-chief by counsel Rakhbir Singh for Amir Ali Khan Nawaty, 40, who was charged with committing culpable homicide not amounting to murder of Norikoh Saliwa, 16, four months ago.

The charge stated that the accused had allegedly committed the crime in a moving lorry along Jalan KM 2.8, Langkon from Kota Marudu between 11am and 12.30pm on Nov 25, 2012.

The indictment came under Section 304 (b) of the Penal Code which carries a maximum jail of 10 years, or with a fine, or both, upon conviction.

To a question by the counsel, Rita testified that she also did not detect any sperms or blood related to the accused or any other persons on Norikoh’s anal swab.

“Relating to the victim’s lower vaginal swab, which I carried out blood as well as sperms DNA evaluation, I did not detect any blood or sperms that belonged to any other persons or the accused,” she said, adding that she did not detect any sperms or blood of other persons or Amir Ali Khan on Norikoh’s high vaginal swab.

To another question by Rakhbir, Rita explained that she did not find any sperms or blood of any other persons nor the accused on the victim’s camisole, bra, long pants and long sleeves.

Rita agreed to another suggestion by Rakhbir that there was some blood on Norikoh’s camisole but she did not find any connection between DNA of the blood on the camisole and the accused’s blood.

When asked by Rakhbir about some blood stain on Noriokoh’s bra, Rita answered, “No DNA profile was developed from the blood stain on the bra related to the accused”.

Deputy public prosecutors Raja Zaizul Faridah Raja Zaharuddin and Afzan Abd Kahar conducted the trial while counsel Peter Marajin held a watching brief for the victim’s family.

The trial will continue on Feb 13.
