Mechanic ordered to refund RM1,850 to car owner

KOTA KINABALU: Consumer Claims Tribunal president Datuk Dr Lawrence Thien yesterday ordered a self-employed mechanic to pay RM1,850 to its client for incomplete repairs on a Nissan Serena car.

The claimant, Hajijah Sahabir, said she sent her car to Iskandar Shah Kosmas Abdullah in December 30, 2012 for repairs and paid RM250 deposit.

“The company promised to repair the car in four days, but after four days he asked for another week because he needed to look for the spare parts. Then he asked for another RM800 to buy the parts and I gave him the money.

“Iskandar asked another RM700 for service fees but after 26 days he did not complete his job and I have to send the car to another workshop because I didn’t trust him anymore,” said Hajijah.

In his statement of defence, Iskandar said he was still repairing the car because it was not easy to find spare parts for the particular model.

“I am depending on this car to earn money because I did not take any car until I repair this car. I did not manage to finish the job because she already sent it to another workshop even though I had bought some parts,” he said.

Thien told Iskandar he should not have promised Hajijah that he would repair it in four days and one week if he could not deliver his service on time.

He awarded a total of RM1,850 to Hajijah.
