Man fined for threatening friend over Facebook remarks

KOTA KINABALU: A local man who committed mischief on his friend’s car and threatened him after being angered by friend’s remarks about him on the social network, Facebook, was yesterday fined RM4,000, in default, 17 months’ jail by the Magistrate’s Court here.

Magistrate Nuruhuda Mohd Yusof imposed the fine on Julian Lo Jeh Fu, 27, after he pleaded guilty to two charges yesterday.

On the first count, the undefended accused was fined RM3,000, in default, 11 months’ jail for threatening his 23-year-old friend at the car park of an apartment unit in Penampang on November 11, 2011.

He was convicted under Section 506 of the Penal Code which carries a maximum jail of seven years and be liable to a fine upon conviction.

On the second count, Lo received another RM1,000 fine, in default, six months’ jail for smashing the front and rear glass of the victim’s car at the same time and place.

The charge was framed under Section 427 of the Penal Code which provides for a jail term of up to two years or a fine, or both, upon conviction.

Prosecuting officer Inspector Lim Swee Beng told the court that before the incident, the victim had received a call from the accused saying that he wanted to meet him at the said place. Once the victim arrived at the place, the accused punched him repeatedly and asked who had talked bad about him on Facebook. The accused also forced the victim to say sorry to him through Facebook.

The accused then threatened the victim that if he did not do so, he would not stop disturbing him at his workplace as well as his family.

Meanwhile, an unemployed local man was jailed 10 months for impersonating as a policeman to a 20-year-old man.

Basri Shaifuddin, 41, pleaded guilty before magistrate Cindy Mc Juce Balitus to impersonating a public servant and taking away the victim’s laptop, cellphone and RM100 in cash in front of a restaurant in Inanam at 6.20pm on Oct 21.

The charge framed under Section 170 of the Penal Code carries a maximum jail of two years or a fine, or both, upon conviction.

The court ordered him to serve his jail sentence consecutively with his present jail term for a cheating conviction.

In a separate case, Muslih Taripan @ Mattaripin, 46, was freed from a charge of cheating after the complainant of the case withdrew his police report.

Balitus gave Muslih a discharge not amounting to an acquittal from a charge of deceiving a man of RM13,000 as a car deposit in Putatan on Dec 6, last year. The court was told that Muslih had paid back to the victim the RM13,000.

He was charged under Section 420 of the Penal Code which carries a maximum jail of 10 years or a fine and with whipping, upon conviction.
