Annuar Musa’s case against fam postponed to March 26

SHAH ALAM: The High Court here yesterday fixed March 26, to hear Kelantan FA President Tan Sri Annuar Musa case against the Football Association of Malaysia (FAM), which suspended him for 30 months.

Judge Hadhariah Syed Ismail set the date in her chambers. Annuar’s lawyer Yusfarizal Yussoff when met outside the court said the case was supposed to have proceeded today (yesterday) but since the defendants had applied for a postponement to submit a written submission, the hearing was fixed for March 26.

The court also fixed April 5, as the date for a decision.

“We objected the defendants request for a postponement because they (defendants) were supposed to have submitted a written submission last Friday,” said Yusfarizal.

He added that Hadhariah allowed the case to be postponed to March 26, while the court would also hear an application filed by the defendants on the same day.

Yusfarizal said the court also ordered the defendants to submit a written submission in three weeks.

On April 4, Annuar was slapped with a 30-month suspension by the FAM Disciplinary Committee after finding him guilty of making a negative statement with regard to the national team in the media on Feb 12, 2012.

Annuar allegedly breached FAM’s Article 88 by making a negative statement on the national team’s performance on Feb 12, although Article 88 stated that only the president and secretary-general can comment on the team’s performance.

On June 5, the Kelantan FA President filed an originating summons claiming the charges against him were prejudicial as he was found guilty of violating FAM’s rules before his defence was filed and before the hearing, hence the defendants failed to adhere to proper procedure.

He also claimed that he was not given the right to be represented during the hearing and further sought an injunction to stop the defendants from preventing him from carrying out his duties as FAM’s deputy president.

The originating summons, filed on June 5, 2012 named the association as the first defendant and its secretary-general Datuk Azzudin Ahmad as the second defendant.

He also claimed that the association had failed to satisfy the burden of proof on the charges against him in a disciplinary hearing held on April 4.

The High Court had also dismissed an application by the FAM and its secretary-general to strike out a suit by Annuar, challenging his suspension as FAM’s deputy president. — Bernama
