Cop gets one-year jail, RM10,000 fine for soliciting bribe

PUTRAJAYA: A policeman was sentenced to one year in jail and fined RM10,000 or six months jail in default, after the Court of Appeal convicted him on a charge of soliciting a bribe in 2008.

The three-judge panel led by Datuk Abdul Malik Ishak allowed the prosecution’s appeal to set aside the decision of the Kuantan Sessions Court which discharged and acquitted Lance Corp Borhan Yusof on the third charge of soliciting a RM500 bribe from a woman at a restaurant in Kuantan on July 5 2008.

The panel which also comprised Judge Datuk Azahar Mohamad and Datuk Mohd Zawawi Salleh ordered Borhan, 54, to serve the sentence effective today.

It however dismissed the prosecution’s appeal and upheld the Sessions Court decision to discharge and acquit Borhan on two other bribery charges.

The panel further upheld the Sessions Court decision to discharge and acquit Corp Abdul Jalil Ahmad, 53, who faced the same charge of receiving a bribe as Borhan.

Borhan and Abdul Jalil from the Kuantan police headquarters were charged with soliciting RM2,000 from a woman and her boyfriend as an inducement to refrain from handing them over to the religious department for close proximity, on June 22 2008.

Malaysian Anti-Corruption Commission deputy public prosecutor Mohd Sophian Zakaria prosecuted while Borhan was represented by lawyer Datuk Mohamad Shariff Abu Samah.

According to the facts of the case, the two policemen detained the couple while on patrol that day.

They then solicited RM2,000 as an inducement to not report them to the religious department for close proximity.

The couple did not have much money with them so Borhan obtained RM50 from the man.
