First-time offender released on bond

KUCHING: A first-time young woman offender was released on bond for good behaviour in the sum of RM2,000 for two years from Thursday for dishonestly retaining stolen dresses.

The 26-year-old sales coordinator from Taman Desa Wira, Jalan Batu Kawa, Nurhalini Buhri, was convicted under Section 411 of the Penal Code.

The facts of the case stated that Nurhalini had admitted to have taken two Somerset Bay brand of an adult and a child dress from a shopping mall at Jalan Tun Jugah, at about 7pm on Feb 26.

During the incident, the complainant, a senior assistant security officer found that the clothing stock in the store did not add up.

The complainant later questioned all the staff members who were working that night including Nurhalini, of which she eventually admitted to have taken the two dresses.

A police report was lodged after that and the police arrested her at 10.50pm on Feb 27.

On March 3 at 5.45pm, the police conducted a search at her residence and retrieved the stolen items.

Before passing sentence on the accused, Magistrate Maris Agan said he had considered public interest, nature of the offence, the mitigation of the accused and in view of the fact that she had no previous conviction record and that she had pleaded guilty to the charge, he agreed to the bond.

In another similar offence, a man and a teenager were fined RM2,000 in default six months’ imprisonment each for dishonestly retaining several stolen items.

Magistrate Maris convicted 28-year-old Liew Kuek Tung and 18-year-old Lee Mee Chiang under Section 411 of the Penal Code.

The facts of the case stated that at about 11am on Feb 27, a complainant who lives in Tabuan Laru discovered that his house had been broken into.

The front gate of the house was also damaged and several items had gone missing.

Meanwhile, police personnel who were on patrol on that day had spotted a silver Perodua Kenari car at Jalan Rock which was parked in front of a house.

The police personnel monitored the situation for about 10 minutes and noticed that two men sitting behind were behaving suspiciously.

They later approached the men and conducted a search and found few items believed to be stolen in the car.

Both accused admitted to their wrongdoings and were charged under Section 411 of the Penal Code.
