Former PKR branch leader, housewife jailed 18 months each for cheating

KUALA LUMPUR: Former Rantau Panjang Parti Keadilan Rakyat (PKR) division leader Mohammad Agos Mohd Noor and a housewife were sentenced to 18 months’ jail each by the Sessions Court here yesterday for cheating in a Kelantan datukship award.

Judge Rosbiahanin Ariffin handed down the sentence after finding that Mohammad Agos, 54, and Nor Azimah, failed to raise reasonable doubts against the prosecution’s case in their defence.

Mohammad Agos was charged with abetting Nor Azimah with cheating one Izuldin Hani Mohd Noor by deceiving the later into believing that she could secure the ‘Dato’ Diraja’ award when it was unlawful under the Kelantan State Constitution.

The action prompted Izuldin Hani into handing a Public Bank cheque for RM50,000, dated Dec 7, 2010.

The offence was committed at Restoran Leha Seafood, Taman Melati, Setapak near here at 5pm on Dec 8, 2010.

Nor Azimah was found guilty on three alternatives charges of cheating two men for the same purpose.

The first charge was for cheating Izuldin Hani which prompted the man to hand a the Public Bank cheque for RM50,000 at the same place and time.

For the second and third alternative charge, she was charged with cheating one Salleh Jahaya for the same purpose which prompted the man to hand over two CIMB Bank cheques, dated Nov 12, 2010 and Nov 30, 2010, both for RM75,000.

She was charged with committing the offence at the Brass Café, Hotel Crystal Crown, Port Klang near here between Nov 13 and Nov 30, 2010.

Earlier in mitigation, lawyer Amir Khusyairi Mohamad Tanusi, representing both the accused, said Nor Aziman was unemployed and Mohammad Agos required intensive hospital treatment for his heart problem, high blood and diabetes.

However, deputy public prosecutor Datuk Abdul Razak Musa, said the offence committed was serious as they had deceived many people.

On Nov 2, 2011, Mohammad Agos and Nor Azimah were acquitted and discharged by the same court without their defence being called.

However, the prosecution appealed and on Dec 26, 2011, the High Court ordered that Mohammad Agos and Nor Azimah be called to enter their defence at the Sessions Court. — Bernama
