Woman allowed to withdraw slander lawsuit

KUCHING: The Sessions Court here yesterday allowed a clerk to withdraw her lawsuit against another woman for slandering her.

Ting, 33, had taken legal action against the respondent, surnamed Jong, 36.

Both were working under the same roof at a shopping mall near Jalan Tun Abdul Rahman.

Jong was one of the tenants of the shopping mall.

Ting had demanded compensation for damage caused by the malicious words of the respondent.

In the statement of claim, the plaintiff, a general account and administration clerk at the building said Jong had used expletives in Hokkien when referring to her on various occasions on the same premises, and in the presence of witnesses as well as recorded on CCTV.

She asked for general damages and sought an injunction to prohibit the use or publishing of the malicious words.

The respondent’s application to struck out the case was allowed by the High Court here and a RM10,000 cost was ordered to be borne by the plaintiff.

Ting who was unhappy with the decision appealed to the Court of Appeal and it ruled in her favour.

The case subsequently proceeded for a hearing in the Sessions Court.

After making a few amendments in the statement of claim, the case proceeded for trial.

But two days before the day set for judgment, Ting decided to apply for the case to be struck out. It was allowed by the Sessions Court which ordered her to pay RM5,000 in cost.
