Man facing five drug possession charges

KOTA KINABALU: A local man was charged in the Sessions Court here yesterday with five counts of possessing drugs namely, marijuana, ecstasy, Nimetazipam and Ketamine.

Alvin Lim Tze Shing, 29, who appeared before the deputy registrar of the High Court, Hafizi Abdul Halim, was charged under Section 12 (2) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39A (2) of the same Act.

The indictment carries a punishment of life imprisonment, or a jail term of not less than five years, and whipping of not less than 10 strokes of the cane, upon conviction.

Lim was alleged to have in his possession 75.81 grams of marijuana (ganja) on March 3, at about 7.55pm at a house at Taman Penampang near here.

Hafizi, who sat as a Sessions Court judge, fixed April 25 for re-mention of the case pending the production of an analysis report of the drug.

Meanwhile in the Magistrate’s Court, Alvin faces another four charges of committing a similar offence.

The first count accused him of possessing 15.65 grams of ecstasy at the same place about 7pm on March 6. The offence was framed under Section 39A (1) of the DDA which is punishable by a jail term of between two and five years and whipping, upon conviction.

On the second and third charges, Lim was alleged to have in his possession, 10.78 grams of Nimetazipam and 15.46 grams of Ketamine respectively, at the same time and place. Both the charges were framed under Section 12 (3) of the DDA 1952 which provides for a fine of up to RM100,000 or a jail term of up to five years, or both, upon conviction.

Meanwhile on the fourth count, Alvin was accused of consuming syabu at the Penampang police station on the same day about 10pm. He was charged under Section 15 (1) (a) of the DDA 1952, which carries a maximum jail term of two years or a fine of up to RM5,000, or both, upon conviction.

Magistrate Nuruhuda Mohd Yusof adjourned the case to May 28 for re-mention pending a chemist’s report on the drugs.

Alvin, who was undefended, was denied bail and ordered to be further remanded in custody pending the disposal of his case.
