Three men fined for committing mischief

KOTA KINABALU: Three local men were each fined RM3,000, or in default, five months’ jail by the Magistrate’s Court here yesterday for committing mischief.

Debby Fernandez Antong, Philip Boniface Molidin and Sokunil @ Sylvester James admitted before magistrate Nuruhuda Mohd Yusof to their joint charge under Section 427 of the Penal Code, read together with Section 34 of the same Code, which provides for a jail term of up to two years or a fine, or both, upon conviction.

The trio were caught for committing the offence on May 17, 2009 at an entertainment outlet in Penampang.

The facts of the case stated that on May 17, 2009, the complainant, who works at the outlet, had lodged a report on the same day about 10pm that while he was on duty, the three men came and sat at one of the tables and started making noises. They then went on to smash the chairs and caused damage to the properties in the premises.

They approached the complainant, who was at the DJ counter at that time, with the intention to injure him (the complainant) but was prevented from doing so by the complainant’s colleagues. The three accused then left the place.

Investigation into the matter revealed that the trio were apparently dissatisfied with the complainant over some matter.

Prosecuting officer Assistant Superintendent Sabrina Jinius appeared for the prosecution.
