Man’s application for stay of execution dismissed

KOTA KINABALU: An application for a stay of execution by a local man for his jail term for six counts of having fake temporary identification documents pending an appeal at the High Court was dismissed by the Magistrate’s Court here, yesterday.

Magistrate Herlina Muse made the decision on Ajak Abdul Hari, 67, after hearing submissions from his counsel Zamzuri Pandikar Amin and deputy public prosecutor Chow Siang Kong.

On March 26, Magistrate Cindy Mc Juce Balitus imposed the custodial sentence on Ajak, who was charged under Section 474 of the Penal Code which provides for a maximum jail of seven years and also liable to a fine, upon conviction.

On the first to the six charges, he was jailed for 16 months each for committing the offences at a room of a hotel at Inanam Business Centre on March 21.

The charges stated that the documents were under the names of Linda Majid bearing numbers 640510-12-5124, Mohd Alfian Sumail bearing numbers 940719-12-6941, Rapiya Ibrahim bearing numbers 790323-12-6990, Daneil Ibrahim bearing numbers 880406-12-6585, Fatima Aliha Mohammad bearing numbers 721228-12-6296 and Nurhidaya Abdullah bearing numbers 920824-12-5340.

The accused, a former Marine Department officer, was ordered to serve his jail terms consecutively.

Meanwhile, in the Sessions Court here, a local man was jailed 11 years and ordered to be whipped twice for armed robbery.

Judge Ismail Brahim meted out the sentence on Hanafie Patrick, 23, after he pleaded guilty to a charge under Section 397 of the Penal Code which carries a maximum jail of 20 years and also liable to whipping, upon conviction.

He admitted to robbing a woman aged 36, of a cashier machine, cash RM138.60 and 16 boxes of cigarettes at a 24-hour shop in Kolombong, Inanam, on Dec 8, 2011.
