Engineer’s judicial review application against EC dismissed

SHAH ALAM: The Shah Alam High Court yesterday dismissed a judicial review application filed by an engineer residing in the United Kingdom to compel the Election Commission (EC) to remove his name from the electoral roll.

Judge Vernon Ong made the decision in chambers.

S K Dinesh, 32, named the EC and the Selangor EC chief registrar as respondents.

His father, K Siva Kumar, 63, filed the suit on Dinesh’s behalf at the High Court registry here through Messrs SN Fam & Co on April 4.

In his application, Dinesh had sought an order for the EC to remove his name as a voter from the electoral roll for Klang, claiming that he had never registered himself as a voter.

Lawyer John Fam, representing Dinesh, when met by reporters, said his client’s application was dismissed on grounds that Regulation 25 (5) of the Elections (Registration of Electors) Regulations 2002 did not allow any alteration or change to the electoral roll during the period beginning on the day of the dissolution of parliament or any state legislative assembly.

The judge, he said, also cited Regulation 25 (2) (g) of the same regulation that it was the discretion of the EC to remove or amend the names from the electoral roll.

Hence, the court was not inclined to interfere the discretion of the EC chief registrar, he added.
