Man gets jail, whipping for four charges

KUCHING: A general worker will face eight years in prison and three strokes of the rotan for committing robbery, criminal intimidation, possessing a dangerous weapon and mischief last year.

Mohamad Noorhairel Bujang, 32, from Kampung Tanah Hitam was sentenced by Sessions Court Judge Amelati Parnell after he was found guilty of all the charges framed against him.

Noorhairel robbed Ling Ung Chai of RM200 at her restaurant in Sematan about 4pm on May 29 last year.

He was also found guilty of intimidating Ling with a kwang tao (knife) while threatening her against lodging a police report about the robbery.

For the third charge, he was found guilty of possessing the kwang tao.

Noorhairel also committed mischief by smashing the cash register and cashier’s table in the restaurant with the kwang tao when he ran amok.

The estimated total loss of the restaurant’s property was about RM300.

He was sentenced to eight years in prison and three strokes of the rotan for the robbery charge, three years’ jail for committing intimidation, two years’ jail for possessing the dangerous weapon and one year’s jail for mischief.

All the custodial sentences were ordered to run concurrently but to take effect after he completed his current jail term.

Noorhairel is currently serving six years in jail and three strokes of the rotan for robbing and intimidating a man in Lundu last year.

Robbery comes under Section 392 of the Penal Code, which provides for 14 years’ jail, a fine or whipping.

Criminal intimidation comes under Section 506 of the same Code, which carries a maximum two years’ jail and whipping.

Possessing a dangerous weapon comes under Section 6(1) of the Corrosive, Explosive, Substances and Dangerous Weapons Act 1958, which carries a jail term of not more than two years and whipping.

Meanwhile, mischief comes under Section 427 of the Penal Code, which provides for a prison term of not more than two years or a fine.
