Local charged with cheating man of RM205,000

KOTA KINABALU: A local man will be tried on July 8–10 this year in the Magistrate’s Court here for four counts of cheating a 57-year-old man of RM205,000 last year.

Sim Cheong EE, 35, who appeared before magistrate Nuruhuda Mohd Yusof yesterday, was charged under Section 420 of the Penal Code which carries a maximum jail of 10 years and whipping and also liable to a fine upon conviction.

On the first count, the unrepresented accused was alleged to have cheated the man by saying that he was selling two units of excavators and allegedly induced the victim to give the accused RM48,000 as a deposit at an office in Luyang at 11am on Sept 7, 2012.

The second charge accused Sim of deceiving the same man RM41,000 for another four excavators at the same place at 11am on Sept 8, 2012.

The third count accused Sim of cheating the victim RM27,000 by inducing him to believe that he was selling wood at the same place on Sept 11, 2012.

On the fourth count, Sim allegedly deceived the victim by saying that he was selling another two excavators and induced him to hand over RM89,000 to the accused at the same place at 2pm on Sept 11, 2012.

The accused was denied bail and ordered to be further held in custody, pending disposal of his case.

Prosecuting officer Inspector Syahrin Ali told the court that the accused had three previous convictions of cheating in 2007 and 2010.

The prosecution will call nine witnesses to testify against the accused during the trial.

In a separate case, a 17-year-old local teenager was charged with murdering a boy and causing grievous hurt to another two juveniles.

On the first count, the accused was charged with killing the 19-year-old boy at Kampung Sembulan here at 4.36am on May 2.

The offence was framed under Section 302 of the Penal Code which carries the mandatory death sentence upon conviction.

On the second and the third charges, he was alleged to have caused hurt to the two boys at the same time and place.

Both the charges were framed under Section 326 of the Penal Code which provides for a jail term of up to 20 years and also liable to a fine, upon conviction.

No plea was recorded from the undefended boy.

The court set June 20 this year for re-mention of the case pending the production of the DNA and medical report of the victims.

He was ordered to be detained in custody under Section 259 of the Criminal Procedure Code.
