PKR files poll petitions for Kota Marudu, Pensiangan, Kudat

KOTA KINABALU: The three Parti Keadilan Rakyat (PKR) candidates who lost in the recent 13th general election have filed in their respective election petition seeking to nullify the election result of the Kota Marudu, Kudat and Pensiangan seats.

Datuk Maijol Mahap and Datuk Richard Sakian Gunting filed their petitions through their appointed counsel, Fulton Mark Sitiwin, while Rahimah Majid filed hers through her appointed legal firm RM Jarin and Co, at the High Court’s registry at 3 pm yesterday.

Maijol named BN-PBS candidate Datuk Maximus Ongkili as the first respondent, returning officer for the Kota Marudu parliamentary seat and the Election Commision (EC) as the second and third respondents, respectively.

In the petition, he raised issues on the use of the indelible ink, instances of money bribery and the failure to observe the election law which he claimed had affected the result of the election as a whole.

In the May 5 general election, Mahap was involved in a four-cornered fight with Ongkili of BN-PBS, Majamis Timbong of STAR Sabah and Yuntau Kolod @ Kuntau Kolod of SAPP.

Maximus won the seat by 842 votes majority after he garnered 15,168 votes to Mahap 14,326 votes while Majamis and Yuntau received 2,228 votes and 444 votes respectively.

Meanwhile, Gunting was involved in a four-cornered fight with Tan Sri Joseph Kurup of BN-PBRS, who polled 9,467 votes against Gunting’s 7,723 votes while Sabah STAR candidate Martin Tomy @ Tommy garnered 3,554 votes and independent candidate Fatimah Agitor@ Mohd Daud only got 152 votes.

As for Rahimah, she named BN-Umno candidate Datuk Abd Rahim Bakri as the first respondent, returning officer for the Kudat parliamentary seat the second respondent and the EC the third respondent.

The seat was won by Abd Rahim, who obtained 21,883 votes, with a majority of 12,736 votes.

Meanwhile, a 36-year-old voter, Jaffari Waliam filed his election petition in Sandakan through counsel Marcel Jude Joseph challenging the validity of the outcome of the Libaran constituency’s election

He named the returning officer for Libaran parliamentary seat, Jeffery Aman, as the first respondent, chairman of the Election Commission (EC), Tan Sri Abdul Rashid Abdul Rahman, as the second respondent and the winning candidate Datuk Juslie Ajirol of BN as the third respondent.
