Former KDM Malaysia president’s application struck out

KOTA KINABALU: Penampang Umno divisional head Datuk John Ambrose lost in his judicial review at the High Court here yesterday seeking a declaration that he is the lawful and valid president of Persatuan Kadazan Dusun Murut Malaysia (KDM Malaysia).

Judge Chew Soo Ho struck out with costs his application which was filed on Sept 3, 2012, naming the Registrar of Societies (ROS) and Datuk Peter Anthony as the first and the second respondents respectively.

The court ordered him to pay RM4,000 costs each to the respondents.

In his application, Ambrose was seeking for a declaration that Anthony is not and never was the president of KDM Malaysia.

He was also seeking for an order of certiorari to quash the decision of the first respondent contained in a letter dated August 7, 2012 which stated to the effect that the association’s Extraordinary General Meeting (EGM) and Annual General Meeting (AGM) 2012 were held in compliance of the relevant provisions of the Societies Act and a declaration that no AGM 2012 was ever conducted or held, and alternatively even if the said AGM was held, such meeting was unlawful, null and void.

Ambrose was seeking for an injunction to restrain Anthony from undertaking any duty or action as president of KDM Malaysia, damages against both respondents, costs, statutory interests and any other relief deemed fit by the court.

Ambrose was represented by counsel Marcel Jude Joseph, Anthony was defended by counsel Wendy Lee while Senior Federal Counsel Rahazlan Afendi appeared for the federal Attorney General Chambers.
