Man fined for breaking into house

KUCHING: A wiring man was fined RM2,000 in default 30 days’ imprisonment after he pleaded guilty to a house break-in charge yesterday.

Boon Yean Shung, 23, from Stampin appeared before Magistrate Zulhairil Sulaiman who passed the sentence after taking into consideration the nature and seriousness of the offence.

Boon committed the offence on March 25 at about 9.30pm when he broke into a house at High Park Phase 5, Mile 18.5, Kuching Serian Road.

On June 17 at about 9.45pm, a police team led by ASP Lawrence Raweng raided a house at Stampin Resettlement Scheme and arrested him.

Boon pleaded guilty at the first instance and this had saved court time and expenses.

In his mitigation, he said he was very remorseful of his wrongdoing and pleaded for leniency in his sentence. It was also his first offence.

As submitted by the counsel of the accused, the complainant did not suffer any losses but the magistrate said the trauma which came later would not be able to be quantified.

However, he took into consideration the age of the accused in sentencing as well as the appropriateness of the sentence.

As much as the aim of the sentence is to punish but the main focus is to rehabilitate, the magistrate said. As such, the court chose to fine the accused as the magistrate believed the five days spent in remand had taught the accused a lesson.
