KOTA KINABALU: The Sessions Court yesterday jailed a local man for 20 years and ordered him to be whipped 10 times for raping his underage daughter.
The 34-year-old pleaded guilty before court judge Duncan Sikodol to a charge of raping his 13-year-old daughter at an unmarked house in Luyang on May 24 this year.
The facts of the case revealed that the accused had started raping the victim since she was six years old.
He would rape her at their home when her mother was at work or when her two other siblings were sleeping, almost everyday.
The victim’s police statement revealed that the accused would sometimes carry her from her bedroom to his bedroom for sex.
Deputy public prosecutor Wan Azwan Aiman Wan Fakhruddin urged the court for a heavy sentence taking into account the victim’s age and the fact that she was raped for six years.
In mitigation, the accused said he had no intention to rape the victim because he faced problems with his family.
He was convicted under Section 376 (3) of the Penal Code which provides for a maximum 30 years’ jail and not less than ten whippings upon conviction.
The victim’s mother had lodged a police report against the accused on June 6 this year and his case was first brought to court on June 14 this year.
