Three months’ parole for taking girlfriend’s mobile phone

KUCHING: A hawker selling barbequed chicken was put on a three-month parole by a Sessions Court here yesterday after he pleaded guilty to stealing his girlfriend’s mobile phone end of last year.

Accused Mohamad Iswandy Jemat, 27, from Kampung Astana pleaded guilty to the charge and was convicted under Section 392 of the Penal Code.

Iswandy had grabbed the mobile phone from his 20-year-old girlfriend at 10.30pm on Dec 26, causing her hurt. He committed the act in a house at Lorong Pah Ghani, Jalan Hashim Jaafar here.

It was learnt that he wanted to check his girlfriend’s incoming and outgoing calls and messages as he suspected she was cheating on him.

Defence counsel Abdul Rahman Mohd Hazmi who represented the accused, in submitting the mitigation, said the accused had been remorseful, repented and vowed not to repeat the offence.

“He has apologised to the victim and it was accepted, and they have been able to leave the past behind them to continue their own lives while remaining friends,” he said.

Abdul Rahman said he will soon tie the knot with his new girlfriend.

The lawyer yesterday said it was first case in Kuching that an accused was put on parole. Other cases were in Sri Aman and Bintulu.

In passing judgement, the judge said: “As per Section 5(1) of the Offenders Compulsory Attendance Act, I hereby order the accused to undertake compulsory work for a period of three months at four hours a day, subject to activities specified by the parole officer.”

“The Court also ordered the accused to furnish a bond of RM1,000 with one local surety,” she said when delivering the judgement.

Iswandy was reminded by the court that if the parole was revoked, he would be serving a three-month custodial sentence.
