Two firms fined over smoky vehciles

KOTA KINABALU: The Sessions Court here yesterday fined two companies RM6,000, in default, one month imprisonment for excessive smoke emissions from their vehicles.

Judge Azreena Aziz imposed the fine on Lim Yoke Kwang, representing Kota Unggul Sdn Bhd, after he admitted that the company’s vehicle had emitted black smoke with intensity levels of 97.6% exceeding the maximum permitted level of 50% through its exhaust, on October 16 2012, at Jalan Beaufort-Sipitang.

The company was charged under Section 22 (1) of the Environmental Quality Act 1974, which is punishable with a maximum fine of RM100,000, and also liable to imprisonment, upon conviction.

In the second case, Liaw Pau Yet from Kian Sin Welding Shop, a Sarawakian company, admitted that the company’s vehicle had emitted black smoke with intensity levels of 84.7% exceeding the maximum permitted level of 50% on January 30, 2012 in Papar.

Kian Sin Welding Shop was charged and fined under Section 22 (1) of the same Act.

Both cases were prosecuted by the Sabah State Environmental Department’s prosecuting officer, Hashim Awang.
