Man gets 14 months for injuring ex-girlfriend

KOTA KINABALU: The Magistrate’s Court here jailed a self-employed man for 14 months for two counts of injuring his former girlfriend last year.

On the first count, Magistrate Nuruhuda Mohd Yusof imposed eight months’ jail on Ryner Augustine, 23, for hurting his 25-year-old ex-lover in a car at an apartment in Jalan Bundusan, Penampang on June 25, 2012.

On the second charge, he received another six months in jail for committing a similar offence on the same victim on the same day at the same house.

The two charges under Section 323 of the Penal Code carry a maximum jail of one year or a fine or both, upon conviction.

The magistrate ordered Ryner, who was represented by counsel Datuk Nobert Chin, to serve his jail terms concurrently from the date of the decision.

However, Nuruhuda granted Ryner stay of execution pending his appeal at the High Court and released him on RM4,000 bail deposited with one local surety, pending disposal of the case.

On Feb 1 this year, the same court had fined Ryner RM2,000, in default, 10 months in jail after finding him guilty of the two charges.

After that, the prosecution had appealed to the High Court against the sentence to which the High Court ordered the case to be remitted back to the same Magistrate’s Court to make a decision on the sentence.
