Security guard denies sodomizing boy

KOTA KINABALU: A local security guard claimed trial to a charge of sodomizing an eight-year-old boy, at the Sessions Court here yesterday.

Judge Azreena Aziz fixed Jan 3-4 next year for the trial of Ismail Hassan, 36, who denied performing anal sex on the victim on Aug 7 at a house in a village behind Jalan Tuaran Bypass here.

The offence, under Section 377C of the Penal Code, provides for a maximum 20 years’ jail and is liable to whipping, on conviction.

Azreena denied bail for Ismail, who is a neighbour of the victim.

Meanwhile, in the same court, Azreena fixed Nov 11 to 13 for the trial of Elvan Durren James.

The 23-year-old accused pleaded not guilty to a charge of raping a 14-year-old girl with disability, on Dec 14, 2011, at a village in Kota Marudu.

The charge under Section 376 (1) of the Penal Code is punishable with a maximum 20 years’ imprisonment, and liable to whipping, upon conviction.

He was released on bail of RM10,000, with RM5,000 to be deposited immediately, plus two local sureties.

The court also ordered the accused to report to the nearest police station once a month, pending his next appearance in court.

In a third case, Danggia Ahau, 22, pleaded guilty to raping a 14-year-old girl on Sept 9, 2009 at a village in Kampung Sosob, Pitas.

However, Azreena deferred sentencing to Sept 2 pending the victim’s impact statement.

He was charged under the Section 376 (1) of the same Act for the offence.

The court imposed a bail of RM10,000, with a RM5,000 deposit, and two local sureties on the accused.
