Death sentence on murder accused affirmed

KOTA KINABALU: The Federal Court here dismissed an appeal by a man against his conviction for two counts of murdering two underage sisters, aged six and 17 years old, respectively.

Justice Tun Arifin Zakaria leading a five-panel sitting, with Tan Sri Abdul Hamid Embong, Dato’ Hasan Lah, Datuk Zainun Ali and Dato’ Jeffery Tan Kok Wha ruled that there was no merit in the appeal made by Rudy Jupri.

The court affirmed the conviction of Rudy, defended by counsel PJ Periera, and the death sentence meted out by the lower court against him.

On July 28, 2011, the High Court of Sandakan convicted Rudy for both murders under Section 302 of the Penal Code which carries the mandatory death sentence.

On the first count, he killed the older sister between 10am and 5pm, on April 15, 2009, in an unmarked house at Kampung Lung Manis, Beluran.

On the second count, he murdered the younger sister at the same time and place, on the same date.

He brought forward an appeal to the Court of Appeal against his conviction on October 12, last year but was dismissed on the grounds that it had no merit.

The prosecution was led by deputy public prosecutor Mangai Krishnan.
