KOTA KINABALU: A local lorry driver was jailed for 10 years and ordered whipped with one stroke of the cane by the Sessions Court here yesterday for raping his teenage niece.
Judge Azreena Aziz imposed the sentence on the 37-year-old uncle after he pleaded guilty to raping his 14-year-old niece at a house in Kinarut on Dec 28, 2012.
He was convicted under Section 376 (2) (d) of the Penal Code which provides for a maximum jail term of 30 years and also liable to whipping, upon conviction.
Deputy public prosecutor Chow Siang Kong told the court that on the day of the incident, the victim’s mother was not at home when her uncle entered her room and locked the door.
The accused then asked the victim to take off her shirt and raped her. The rape only took place once but most of the time the accused had inserted his finger into the victim’s vagina.
The incident happened continuously until March. The medical report of the victim showed that there was a tear in her hymen.
The accused was also ordered to be placed under police supervision for two years.
Meanwhile, in the same court, a local married man received five years’ imprisonment and a whipping for raping his teenage lover.
Mohamad Azizan Mat Jandi, 25, admitted to raping his 15-year-old girlfriend at an unnumbered house in a village in Beaufort on August 28.
Apart from that, the judge also ordered Azizan, who was undefended, to pay RM20,000 compensation to the victim, in default, six months’ jail.
He was charged under Section 376 (1) of the Penal Code which carries a maximum jail of 20 years and also liable to a fine, upon conviction.
The prosecution told the court that the victim’s mother lodged a report after knowing that her daughter was having a relationship with a married man whom the victim got to know less than a month.
Chow also said that the accused is a married man and has one child, however his wife did not know that the accused was having a relationship with another girl.
