Woman jailed, fined for cheating civil servant

KOTA KINABALU: A jobless local woman was jailed a total of three years and two months and fined RM3,200 by a Magistrate’s Court here yesterday for cheating a civil servant on three occasions that she could facilitate the process of a house application.

Magistrate Cindy Mc Juce Balitus imposed the sentence on Kee Noorayudah Mohd Ayub, 26, after she pleaded guilty to each of the charges framed under Section 420 of the Penal Code. The indictment carries a maximum jail of 10 years and whipping and also liable to a fine, upon conviction.

On the first and second counts, the accused was sentenced to one year’s jail and fined RM1,000, in default, one month’s imprisonment each for cheating the 26-year-old civil servant of RM8,370 and RM2,500 respectively, by representing that she could facilitate the application process of a Town and Housing Development Board’s (LPPB) house at Taman Layar Impian in Tuaran.

On the third charge, she was jailed another 14 months and fined RM1,200, in default, one month’s jail for cheating the same victim of RM9,900 for the same purpose.

The two offences were committed at a restaurant in Cyber City on December 29, 2012 and the third was at the State Education Department on December 24, 2012, respectively. The magistrate ordered the accused to serve her jail sentences consecutively.

Prosecuting officer Assistant Superintendent Sabrina Jinius prosecuted while Kee, who hails from Tawau, was unrepresented.

Meanwhile, at the Sessions Court here, a local man will stand trial on February 13–14 next year on two charges of cheating and forgery.

Ismail set the hearing dates when the case came up for mention yesterday in the case of Frederick Mathew, 45, who was present in court.

On October 10 this year, the same court had issued an arrest warrant for the accused after he failed to turn up in court for his trial.

The accused’s counsel, Batholomew Jingulam, informed the court that his client had forgotten his trial date thinking it was in December.

On the first count, Frederick was alleged to have between July 1–15, 2011 at a house in Telipok, induced one Ngon Hoo Han, 59, to hand over to him an original grant and a Perodua Viva vehicle bearing plate number SAB9214A for the purpose of selling the car.

On the second charge, he was alleged to have deceived one Noraisah Abdillah, 41, to hand over her car registration card bearing serial numbers 8737548 to him for the purpose of making a copy but instead he handed it to Ngon Hoo Han at the Road Transport Department (RTD) office on July 15, 2011.

On the third count, he was alleged to have forged ‘Borang JPJ K3 NO C1496524’ in order to transfer the name registered on the Perodua Viva bearing plate number SAB9214A, to his name, on July 15, 2011 at the RTD office here.

The charges preferred fall under Section 467 of the Penal Code which provides for a maximum of 20 years’ jail and also liable to a fine, upon conviction.

The accused is currently released on bail pending disposal of the case.
