KOTA KINABALU: An army personnel from Tawau was fined RM25, in default, seven days’ jail by a Magistrate’s Court here yesterday for threatening a police sergeant.

Magistrate Cindy Mc Juce Balitus imposed the fine on Asri Amiruddin, 31, after he pleaded guilty to making the threat through short messaging service (SMS) to the policeman. The sms stated “Don’t wait until I look for you”, which had caused fear to the victim.

Asri, who was represented by counsel Ram Singh, was alleged to have committed the offence at Kampung Malawa in Sepanggar on June 12.

The offence was framed under Section 8 (1) (e) of the Minor Offences Ordinance which is punishable by a maximum fine of RM25, upon conviction.

Prosecuting officer Inspector Syahrin Ali told the court that after receiving the text from the accused, the victim, who feared for his safety, immediately lodged a report against the accused.

In pleading for a light sentence, Ram told the court that his client felt remorseful for what he had done and urged the court to impose a minimum sentence as the accused, who holds the rank of captain in the armed forces, is the sole breadwinner.

The prosecution prayed for a higher sentence to be imposed on the accused taking into account the facts of the case.
