Store owner gets jail, fine for bribery

KOTA KINABALU: The Corruption Court here yesterday sentenced a local man to one day’s jail, and fined him RM10,000, in default, four months’ imprisonment for bribing an agent of DBKK Holdings Sdn Bhd.

Judge Caroline Bee Majanil meted out the sentence to Fazir Karim Aman Dal, 47, after he pleaded guilty to the charge.

Fazir, 47, a sundry store owner, bribed one Zarah Limat as inducement to change the name of a tenant on a lease agreement for a business premises, Kedai Runcit Grace, at Bandaraya (North) Bus Terminal, Inanam. The offence was alleged to have taken place on February 28 this year at the DBKK Holdings Sdn Bhd’s office at Bandaraya (North) Bus Terminal, Inanam.

The charge under Section 17 (b) of the Malaysian Anti-Corruption Commission Act 2009 and punishable under Section 24 of the same Act, carries a maximum of 20 years jail and a fine of up to five times the bribe or RM10,000, depending on which is the higher amount, upon conviction.

The court also ordered for the bribe money to be forfeited.

Deputy public prosecutor Joyce Blasius acted for the prosecution while counsel Chau Chin Tang represented the accused.

Meanwhile, the same Court fixed January 9, 2014, for the next mention of Riduan Masmud’s case.

Riduan, 40, faces three charges for corruption under Section 16 (b) (A) of the Malaysia Anti-Corruption Commission Act 2009 (694 Act) in addition to his ongoing statutory rape trial.

The charge provides for maximum jail of 20 years and a fine of up to five times the bribery amount or RM10,000 depending on which amount is higher, upon conviction.

On the first count, the accused was alleged to have corruptly offered the rape victim’s father RM5,000 as an inducement for the victim to withdraw her police report for rape against him.

The alleged offence was reportedly committed outside a security hut of an education institute along Jalan Tuaran ByPass at about 9pm on April 18.

For the second and the third charges, Riduan was accused of giving the same man RM2,000 and RM3,000, respectively, for the same purpose outside a security hut of an education institute at Jalan Tuaran ByPass at about 9pm and at a canteen at Jalan Tuaran Lama between 11pm and 12 midnight, respectively, on the same day.

The prosecution had prayed for another mention date as Riduan’s rape case was still ongoing in another court.
