KOTA KINABALU: A worker of a company was jailed for eight months and fined RM1,000, in default, six months in jail by a Magistrate’s Court here yesterday for dishonestly misusing RM210 in cash belonging to his employer.

Senior assistant registrar Dzul Elmy Yunus imposed the sentence on Md Zackaria Md Jamrin, 28, who pleaded guilty to a charge under Section 403 of the Penal Code which provides for a jail term of up to five years and whipping or a fine, upon conviction.

The unrepresented local accused admitted to misusing the payment for car rental for his own interest at Jalan Sulaman Central in Sepanggar, Menggatal on October 24.

Prosecuting officer Inspector Lim Swee Beng told the court that the complainant contacted one of their customers and asked why the customer did not make full payment before renting the car.

The customer said that he had paid the rental fee to the complainant’s worker but the complainant only received RM100 of the full amount that the customer should have paid.

The complainant then lodged a police report and investigation revealed that the accused had taken half of the full rental paid by the customer to him.

In a separate case, local Mohd Hamzah Matali, 43, was sentenced to six months in jail by the same court for possessing 0.21 gram of syabu at Kampung Warisan in Inanam on September 3.

He pleaded guilty to a charge under Section 12 (3) of the Dangerous Drugs Act 1952 which carries a maximum fine of RM100,000 or a jail term of up to five years upon conviction.
