Appeal against conviction for manslaughter dismissed

KOTA KINABALU: The High Court here yesterday dismissed an appeal by a local man against his 12 years’ jail for manslaughter.

Justice Ravinthran Paramaguru upheld the sentence of Marius Ukin, 40, who was convicted by the lower court on April 25 this year.

In his decision, Paramaguru ruled that there was no error found in the judgment and there was also no merit in the appeal.

The appellant who was defended by counsel Datuk Chau Chin Tang had caused the death of one Aedwin Philip, 43, by kicking his face at a vegetables storehouse in front of a cottage hotel in Kundasang on November 2, 2012.

The offence was framed under Section 304 (a) of the Penal Code which carries a maximum jail of 30 years and a fine, uon conviction.

Deputy public prosecutor Raja Zaizul Faridah Raja Zaharuddin appeared for the respondent.
