Dec 27 case management of local charged with molesting granddaughter

KOTA KINABALU: The Magistrate’s Court here yesterday set December 27 this year for case management of a 63-year-old local man who was charged with molesting his granddaughter.

The unrepresented accused, who appeared before deputy registrar of the High Court, Amir Shah Amir Hassan, had initially pleaded guilty to outraging the modesty of his six-year-old grandchild but he disputed some of the facts of the case.

Amir Shah, who sat as a magistrate, rejected the guilty plea of the accused, who was alleged to have committed the offence at the room of a house in a village in Penampang between 4pm to 7pm in May, 2013.

The indictment came under Section 354 of the Penal Code which is punishable by a maximum jail of 10 years or with a fine and whipping, upon conviction.

The court released him on RM5,000 bail with two local sureties, pending disposal of the case.

Inspector Lim Swee Beng appeared for the prosecution.

In an unrelated case, local Ramlee Pakee, 42, was fined RM1,500, in default, two months in jail by the Traffic Court here for driving his vehicle while under the influence of alcohol.

He pleaded guilty to a charge under Section 45A (1) of the Road Transport Act 1987, which carries a maximum fine of RM6,000 or with a jail term of up to 12 months, upon conviction.

He was caught committing the offence along Jalan Tuaran on October 27.
