Rape: Prosecution fails in bid for heavier sentence

KOTA KINABALU: The High Court here yesterday affirmed the sentence of a local taxi driver for raping a teenage girl.

Judicial Commissioner Azahahari Kamal Ramli dismissed the appeal by the prosecution for the sentence against Abdul Salaman, 40, to be increased.

The respondent, who was unrepresented, was found guilty on September 3, 2013, of raping the 16-year-old girl in a car under a village house in Papar on November 21, 2010.

He was jailed for seven years and also ordered to be whipped once by the subordinate court here.

The offence was under Section 376 (1) of the Penal Code which provides for a maximum jail of 20 years and also liable to whippin, upon conviction.

Deputy public prosecutor Afzan Abd Kahar appeared for the appellant.
