KUCHING: The High Court here yesterday fixed Feb 10 to hear the case of a man charged with trafficking one kilogramme of methamphetamine.
The accused Chiong Swee Ling was charged under Section 39B(2) of the Dangerous Drugs Act 1952 which provides a mandatory death penalty upon conviction.
Defence counsels Lim Lian Kee and Shankar Ram indicated to Justice Yew Jen Kie yesterday that they would file a recusal application.
According to brief facts of the case, the 46-year-old, at the time of offence, was alleged to have trafficked 1.025kg of methamphetamine on Aug 17, 2013 at 12.40pm at the compound of an apartment in Batu Kawa here.
The event unfolded when Chiong attempted to evade the police when approached by them.
During inspection, police discovered a black plastic bag in his bag which contained a crystal clear substance suspected to be drug.
