Foreigner jailed over stolen goods

KOTA KINABALU: The Magistrate’s Court here yesterday sentenced a foreigner to three months imprisonment for fraudulent possession of property.

Senior assistant registrar Dzul Elmy Yunus, who was sitting as a magistrate here yesterday, passed the sentence on Abd Rasni Koltis, 31 after he pleaded guilty to the charge.

He admitted to failing to account reasonably for suspected stolen electronic goods including an Astro decoder on Jan 4, this year at a house in Kampung Dumpil, Putatan.

The charge under Section 22A (1) of the Minor Offences Ordinance carries a maximum fine of RM100, or up to three months jail or both, upon conviction.

The court ordered for his sentence to be served concurrent with a four months jail sentence for illegal entry into the State under Section 6 of the Immigration Act 1959/1963.

In a separate case, the same court fined Mohd Al-Fauzin Sham, 35 and Chong Keet Kuan, 26, each RM25, in default, one day jail for separate charges of behaving destructively.

The offence under Section 8 of the same Act carries a maximum fine of RM25, in default, one week jail, on conviction.

Mohd Al-Fauzin pleaded guilty to intimidating his wife on Jan 16, this year at a home in Kampung Sembulan Lama at around 4.30pm.

According to the facts of the case, the victim had refused him cash when he asked for it which caused him to act out in a threatening manner.

Chong also pleaded guilty to behaving in a threatening manner towards his older brother on Jan 15, this year at a house in Taman Suria, Luyang.

Prosecuting officer Inspector Lim Swee Beng prosecuted all three cases.
