Security guard admits to causing hurt and criminal intimidation

KOTA KINABALU: A security guard pleaded guilty at a Magistrate’s Court here yesterday to two counts of causing hurt and criminal intimidation.

Magistrate Herlina fixed April 17 for a re-mention of Shuaimi Mohd Juhur’s case pending the victim’s impact statement and medical report.

Shuaimi, 34, admitted to hurting Nurizwah Baharuddin, 19, at an unnumbered house in Kampung Ketiau, Putatan on September 26, 2013.

He was charged under Section 323 of the Penal Code which is punishable with imprisonment of up to a year, or with fine, or both, upon conviction.

On the second charge, he pleaded guilty to criminally intimidating Baruddin Sabturani, 45, by threatening to hurt him at the same time and place.

The offence framed under Section 506 of the Penal Code is punishable with a maximum of two years’ jail, or with fine or both, upon conviction.

The court released him on RM2,000 bail with two local sureties for each of the charges.

Prosecuting officer Inspector Azaman Hamat prosecuted the case.

Meanwhile, at the Sessions Court, a warrant of arrest issued on two witnesses involved in a robbery trial was vacated after they appeared in court yesterday.

Judge Ishak Bakri then adjourned the trial of Ferdenand Felix Jipont @ Kadok and Fernandez D Mathews @ Bobby to February 19–20.

Both accused were charged with robbing Norhana Fariha Kalong, 28, of RM3,000 worth of valuables on July 7, 2013 at the car park area of an entertainment outlet in Asia City.

The charge under Section 395 of the Penal Code is punishable with imprisonment of up to 20 years and whipping, upon conviction.

The court vacated the arrest warrant after both witnesses appeared in court yesterday to provide an explanation for their absence.

On February 24, this year, the court had issued a warrant of arrest on the two witnesses, who are also complainants of the case, for failing to appear to testify in the trial.

The court was told that one of them was overseas during the said date while another had returned to her hometown.

Ishak extended bail for both the accused.
