KOTA KINABALU: The Sessions Court here yesterday fixed March 27-28 this year for the trial of a former teacher for molesting an underage girl and forcing her to perform oral sex on him.
Judge Dean Wayne Daly fixed the date for Robin Mahadul @ Magasad, 47, when the case was mentioned yesterday.
Robin was first charged with molesting the nine-year-old victim in a classroom of a school in Kudat in March, 2006. The charge under Section 354 of the Penal Code is punishable with imprisonment for a term which may extend to 10 years or with a fine or whipping or with any two of such punishments, on conviction.
The second charge accuses him of inserting his penis into the mouth of the victim in the female rest-room of the same school, sometime in May, 2006.
Earlier, deputy public prosecutor Nartiah F Mirchelle Sambatan informed the court that the prosecution is ready to proceed with the trial, and will call 15 witnesses to testify.
The court had ordered that the trial be conducted in Kudat.
Robin is currently serving three years’ jail term for a conviction under Section 377E of the Penal Code for inciting a child to commit an act of gross indecency.
Meanwhile, in another case, Dean fixed April 9 this year for the trial of a 21-year-old man for statutory rape.
Rusli Lajim is charged with raping a 14-year-old girl in September, 2012, at a house in Kampung Tanjung Aru, Membakut, Beaufort.
The charge under Section 376 (B) of the Penal Code caries a jail term of not less than six years and not more than 20 years, and whipping on conviction.
The court ordered that his trial be conducted in Beaufort and his bail be extended.
