Local charged with trespassing, theft

KOTA KINABALU: An unemployed local man claimed trial at the Magistrate’s Court here yesterday to a charge of trespassing into the house of a man and stealing his properties.

Kong Jian Wei, 30, pleaded not guilty before magistrate Herlina Muse to breaking into the house at Jalan Kobusak in Penampang and stole two cars, RM35,000 cash, a wallet, bank cards, a MyKad and a driving license at 12.30am on January 4.

The accused, who allegedly committed the offence with a friend still large, was charged under Section 457 of the Penal Code, read together with Section 34 of the same Code, which carries a maximum jail of 14 years and also liable to a fine upon conviction.

The court set March 20 this year to re-mention the case and released him on RM5,000 bail with two local sureties.

Meanwhile, the unrepresented accused also faces a charge of consuming syabu.

No plea was recorded from Kong who was caught for allegedly committing the offence at the Penampang police station at 11am on March 4.

The offence was framed under Section 15 (1) (a) of the Dangerous Drugs Act 1952 which is punishable by a fine of up to RM5,000 or a maximum jail of two years, upon conviction.

Herlina reserved April 24 this year to re-mention the case pending his urine result.

For that charge, he was granted RM1,800 bail with two local sureties.
