Ruling on police inspector April 28

KOTA KINABALU: The High Court here will decide on April 28 this year whether or not the prosecution has established a prima facie case against a police inspector charged with killing a single mother three years ago.

Justice Chew Soo Ho set the date to deliver his ruling in the case of Ahmad Rizal Umar, 33, after the prosecution and the defence informed the court through video conferencing that there was no further submission for the case.

Ahmad Rizal Umar was charged under Section 302 of the Penal Code which carries the mandatory death sentence upon conviction.

The accused from Perak, was alleged to have killed 27-year-old Sabahan Kartini Borhan in a house at Taman Adika in Keningau between 4am and 5am on September 29, 2011.

Deputy public prosecutors Syaripuddin Abdul Rasa and Ahmad Nazneen Zulkifli have called 25 witnesses to testify against Ahmad Rizal.

The trial commenced on April 22, 2013, and the accused is currently detained in custody as the alleged offence was non-bailable.

Ahmad Rizal was represented by counsel Ram Singh, Rizwandean Bukhari M. Borhan and YS Lo.

In a separate case, the Magistrate’s Court here fined a local man RM2,100, in default, five months’ jail for possessing 0.04 gram of syabu.

Magistrate Herlina Muse imposed the fine on Walter Unggin, 31, after he pleaded guilty to a charge framed under Section 12 (3) of the Dangerous Drugs Act 1952, which is punishable with a fine of up to RM100,000 or a jail term of up to five years, or both, upon conviction.

Prosecuting officer Inspector Azaman Hamat told the court that the accused was arrested for possessing the drug at Taman Jaya Diri on September 26, 2013.
