March 27 hearing for woman charged with hurting daughter

KOTA KINABALU: The Magistrate’s Court fixed March 27, this year to hear the case of a 68-year-old woman charged with hurting her daughter at the courthouse here.

Magistrate Herlina Muse fixed the date for Margereth Tan’s case at the request of prosecuting officer Inspector Azaman Hamat, pending instruction from the prosecution’s office.

On Jan 29, Margareth was charged with hurting Sylvathy Minsin, 45, near the stairs, outside of the Magistrate’s Court 2, on Oct 28, 2013.

The charge is framed under Section 323 of the Penal Code which provides for one year’s jail or a fine, or both, upon conviction.

On March 5, the victim had testified in court explaining her intention to withdraw the charges against the accused considering their relationship as mother and daughter.

Meanwhile, the same court fixed April 22 for the next mention of Muhamad Kumbing’s case, pending a chemist’s report.

The accused, first charged on Feb 18, was alleged to have trafficked in 77.00 grammes of syabu at a house in Kampung Lok Baru, Pulau Gaya on Feb 6, this year.

The charge framed under Section 39B (1) (a) of the Dangerous Drugs Act 1952 carries the mandatory death penalty, upon conviction.

Prosecuting officer Inspector Azaman Hamat prosecuted both the cases.
