Man fined RM25 for causing fear

KOTA KINABALI: A 49-year-old man was fined RM25, in default, five days’ jail by the Magistrate’s Court here yesterday for causing fear to a 54-year-old man.

Magistrate Ryan Sagirann Rayner Jr imposed the fine on Mohamad Johari Ahmad after the latter pleaded guilty to the offence under Section 8 (1)(e) of the Minor Offences Ordinance which carries a maximum fine of RM25.

Based on the facts of case, the complainant lodged a second police report on January 31, at about 8.35pm, after lodging the first one on October 15 last year.

The complainant was reported to have received five telephone calls and a number of short messaging service (SMS) texts containing harsh words such as ‘tembirang’ (arrogant) and ‘babi’ (pig), from the accused, causing fear to the complainant.

In an unrelated case, a foreigner pleaded not guilty to possessing 7.66 grams of methamphetamines.

Jun Ambut, 51, was accused of committing the offence on November 13 last year around 9.30pm by the river near Sungai Likas Bridge.

The charge, framed under Section 12 (2) of the Dangerous Drugs Act 1952, carries a jail term of up to five years, or a maximum fine of RM100,000, or both, upon conviction.

Magistrate Herlina Muse fixed April 7 for case management and for trial on April 24 to 25.

The court granted no bail and remanded the accused under Section 259 of the Criminal Procedure Code.
