KUCHING: A magistrates’ court here yesterday sentenced two men to 20 months and 24 months in jail respectively after they pleaded guilty to possession of a stolen vehicle last month.

Magistrate Zulhairil Sulaiman imposed the sentences on Mohd Azmi Raji, 28, and Firdaush Syah Hosen, 24, after taking into consideration their mitigations, nature of the offence as well as public interest.

The offence was committed last March 21 around 4am at Kampung Tabuan Lot, Jalan Setia Raja here.

Azmi was sentenced to 20 months in jail, while Firdaush received 24 months as he had a previous conviction, where he was jailed for two weeks for failing to produce his MyKad when they were arrested. According to the brief facts of the case, a police team was told that a white car was abandoned by the roadside at Kampung Tabuan Lot on March 20 around 10pm.

The vehicle had a fake registration number and was believed to be stolen.

During surveillance, two men — identified as Azmi and Firdaush — approached the car at 4am the next day and got in.

When Azmi and Firdaush realised the presence of the police, they sped off to Kampung Tabuan Melayu but the vehicle landed in a ditch after they lost control.

They fled from the scene and hid in the bushes but were captured by the police.

The court convicted them under Section 411 of the Penal Code.

Both were not represented by any defence counsel while Inspector Yunus Sahak prosecuted.
