Khir Toyo’s appeal against conviction postponed again

PUTRAJAYA: The hearing of former Selangor Menteri Besar Dr Mohamad Khir Toyo’s final appeal against his conviction and 12 months’ jail term for corruption has been postponed yet again to an unspecified date.

This is the second postponement, with the hearing initially slotted for Feb 6, but rescheduled for yesterday at the Federal Court here.

Federal Court corporate communications and international relations head Mohd Aizuddin Zolkeply said the court had allowed the postponement after Dr Khir’s counsel Tan Sri Muhammad Shafee Abdullah sent a written request to postpone the hearing last Thursday (April 10) because he was attending a conference in Japan.

Muhammad Shafee is Malaysia’s representative to the Asean Intergovernmental Commission on Human Rights (AICHR) Conference, which begins today.

Mohd Aizuddin said once Muhammad Shafee returns the court would inform both parties to attend a case management, which had yet to be scheduled, to fix a new hearing date.

On Dec 23, 2011, the High Court in Shah Alam found Dr Khir guilty of obtaining for himself and his wife valuable items, namely two plots of land and a bungalow at Section 7, Shah Alam four years ago, and sentenced him to 12 months’ jail.

Dr Khir, 49, was also ordered to forfeit ownership of the properties obtained and hand them over to the government.

On May 30, last year the Court of Appeal dismissed his appeal and upheld the High Court’s decision.

The former Sungai Panjang assemblyman was accused of obtaining for himself and his wife, Zahrah Kechik, 47, two plots of land and a house at No. 8 and 10, Jalan Suasa 7/1L, Shah Alam from Ditamas Sdn Bhd through its director Datuk Shamsuddin Hayroni.

The offence was committed at the official residence of the Selangor Menteri Besar at Jalan Permata 7/1, Section 7, Shah Alam on May 29, 2007. — Bernama
