Court dismisses NFCorp application, sets full trial

KUALA LUMPUR: The High Court here yesterday ordered the National Feedlot Corporation Sdn Bhd (NFCorp) suit against Public Bank Bhd to go for trial.

Judge Datuk John Louis O’Hara made the decision (for the suit to go to trail) after dismissing NFCorp’s application to dispose of the suit over the alleged leak of confidential information, based on point of law.

He dismissed the application with costs of RM5,000 and set Sept 25 for final case management to both parties to file the witness statements for the trial.

The trial will be heard on Oct 9.

In the judgment, O’Hara said the application was filed late and not filed properly, and the issues mentioned were unclear to be disposed of without full trial.

On May 8, NFCorp counsel Hariharan Tara Singh told reporters that his client filed the application under Order 14A of the Rules of Court 2012 as the bank felt that issues could be finally determined by way of the affidavit’s evidence.

However, he said, the bank wanted to go for full trial.

NFCorp, its related companies and its chairman, Datuk Seri Dr Mohamad Salleh Ismail had on May 22, 2012, filed a lawsuit against the bank stating that its business reputation and credibility had suffered irreparable loss and damage as a result of the bank’s security breach of the Banking and Financial Institutions Act 1989 (Bafia). — Bernama
