Man claims trial to three counts of CBT

KOTA KINABALU: A man pleaded not guilty at the Magistrate’s Court here yesterday to three counts of criminal breach of trust (CBT) involving RM13,484.

Syamsu Rizal Umar allegedly committed the offences when he was the assistant head of a residential flat committee.

Magistrate Cindy Mc Juce Balitus set August 25–26, this year for trial and July 16 for management of Syamsu Rizal Umar’s case.

On the first count, Syamsu, 50, as a person entrusted to collect monies, was alleged to have embezzled a collection of RM4,100 meant to pay the water bills of the residents. The offence was alleged to have taken place between February 18, 2013 and June 12, 2013 at a flat unit of Taman Sri Indah, Jalan Sepanggar, Menggatal.

On the second and third charges, he was alleged to have embezzled RM5,276, and RM4,108, respectively, between February 12, 2013 and June 12, 2013.

The charges framed under Section 407 of the Penal Code provide for imprisonment of up to ten years, and with whipping, and shall also be liable to a fine upon conviction.

The court released him on RM3,000 bail with two local sureties.

Inspector Azaman Hamat acted for the prosecution while the accused was unrepresented.
