Remand for first accused while two accomplices still at large

KUCHING: It was a short Hari Raya celebration for one of three accused charged with causing grievous hurt (two charges) after the High Court ordered him to be remanded in prison yesterday.

Second accused, Mohamad Sukmarulnizam Ademan, 23, was arrested in his rented house at Tabuan Park following a warrant of arrest issued against him and two other accused persons last week.

Justice Dato Yew Jen Kie presiding over the case yesterday maintained Sept 10 for the case to be mentioned and the sentencing.

Mohd Sukmarulnizam’s accomplices (first accused) Ramshah Mohd Ramlan, 23, from Kampung Tabuan Tengah and (third accused) Mohamad Fadillah Jamil, 34, from Kampung Tabuan Melayu are still at large.

The trio had been issued warrants of arrest by the High Court after they failed to turn up in court to hear the charges against them last Friday.

Initially, early this month, all of them pleaded guilty to their charges and presiding Sessions Court judge had deferred the sentencing to Sept 10 to enable them to celebrate Hari Raya with their families.

But the sentencing was expedited after a video footage of the incident caught on CCTV went viral on social media.

They face charges under Section 326 of the Penal Code read together with Section 34 which carries a jail term up to 20 years and liable to a fine or whipping upon conviction.

In the first charge, they admitted causing grievous hurt with a machete to Casspetra Bawok and Nicholas Gandik Ningkan, both 19, at a private college at Jalan Muara Tabuan at about 6.30pm on April 6, 2014.DPP Stella Augustine Druce prosecuted.
