MAS unhappy over incorrect report on MH17 compensation

KUALA LUMPUR: Malaysia Airlines (MAS) is deeply disappointed by incorrect opinions published on Sept 14 and 16, entitled ‘MH17 families denied full compensation by Malaysia Airlines’, and written by Nick Miller from the Australian Fairfax media group.

In a statement yesterday, MAS said the articles were published prior to receiving responses to Miller’s questions posed to the lead lawyer handling the claims on behalf of MAS and its insurer.

It said the reports clearly failed to understand the operation of relevant law which in respect of those claiming on behalf of Australian passengers onboard the ill-fated MAS Flight MH17.

“MAS is acutely conscious of its moral and legal obligation to those affected by the terrible tragedy which befell our Flight MH17 and has never sought to avoid paying full compensation, in accordance with the law,” it added.

According to the statement, the advance compensation payment being offered was not conditional on the families waiving any right to claim further compensation from the airlines and they remain free to take any further legal actions.

“The payment is being made in recognition of non-binding, though followed and wholly appropriate international practice, and the payment will be part of the final damages payable,” it said.

It said MAS deeply regretted this style of ill-informed and sensational journalism which only served to highten the stress and emotional tension endured by families of victims of the ill-fated Flight MH17. — Bernama
