Man gets maximum fine for beating sister

KOTA KINABALU: The Magistrate’s Court here yesterday imposed a maximum fine on an unemployed local man who walloped his younger sister.

Deputy registrar of the High Court, Ryan Sangirann Rayner Jr, who presided as magistrate, imposed the RM2,000 fine, in default, six months’ imprisonment on Nazel Rubin, 32, after he pleaded guilty to the offence.

The offence, under Section 323 of the Penal Code, carries a jail term of up to a year or a maximum RM2,000, or both, upon conviction.

Prosecuting officer Inspector Lim Swee Beng said the accused had caused injury to the 23-year-old waitress at 1.30am on July 18 at an unnumbered house in Kampung Tanjung Aru.

Meanwhile, the same court granted the request of a self-employed man who asked the court to impose a fine on him for two counts of possession and consumption of syabu.

Magistrate Ryan fined Ong Choon Theam, 51, a total of RM3,800 after he pleaded guilty to committing both offences.

For the first count, the court fined the accused RM3,000, in default, six months’ jail for possessing 0.13 gram of syabu at 12.15pm on August 2, at Sunshine Hot Bread and Cake House, located on the ground floor of Beverly Hills Plaza along Jalan Bundusan.

The charge falls under Section 12 (2) of the Dangerous Drugs Act (DDA) 1952, which carries a fine of up to RM100,000 or not more than five years’ jail, or both, upon conviction.

For the second count, Ong was fined RM1,800, in default four months’ imprisonment, after being tested positive for syabu consumption here.

The indictment, under Section 15 (1) (A) DDA, carries a fine of up to RM5,000 or a maximum two years’ jail, upon conviction.

The same Magistrate’s Court also set October 29 to hear the case of a Filipino and two other men who were jointly charged with consumption and possession of syabu.

Magistrate Ryan fixed the date for foreigner Herowin Fred, 32, Arsyiu Bami, 35, and Roclee Tamrin pending the chemist’s report.

The trio were detained and found in possession of 5.03 grams of syabu on September 16 at 2am, while they were heading from Putatan to Papar.

While Herowin was remanded by the court, a bail of RM3,000 with two local sureties were offered to the other accused.
