Man freed of dangerous driving charge

KUCHING: A magistrates’ court here yesterday discharged and acquitted a man from a dangerous driving charge.

Hilmi Shaari was freed from the offence after Magistrate Zulbaidah Sharkawi found that the prosecutor had failed to prove a prima facie case against him.

Due to the unsatisfactory features, doubt and gap in the prosecution’s case, Zulbaidah ruled it was unsafe for the court to conclude and subsequently discharged and acquitted Hilmi
without calling for his defence.

He was accused of driving recklessly and causing the death of a motorcyclist around 9.40pm on Sept 5 last year at Jalan Depo here.

Reckless driving under Section 41(1) of the Road Transport Act 1987 provides for two to 10 years in prison, and a fine from RM5,000 to RM20,000.

DPP Samira Khalili prosecuted while the accused was represented by counsels Osman Ibrahim and Fadzillah Osman.
